It's a requirement of his current contract. Contractually, he has to receive a notice like this before he can be officially terminated. If they don't provide this notification and an opportunity for him to refute the allegations within, they cannot fire him for cause. If they didn't go through this process, they'd still be on the hook to pay him.

 In the South Quad cafeteria, 30+ years ago, I and two girls and another guy had "brainstorm" of all of the phrases for masturbation.   It was endless.  On subsequent days we did breasts and genitalia.  I moderate brainstorms now and then and a lot of people are just not able to get out of the box, so to speak.  I've always wanted to do a dirty brainstorm as a warm up to get everyone's juices flowing.  Sadly,  I'd end up like Mel Tucker if I did that.

Shouldn't he have been suspended when he admitted to having a relationship with her and polishing his bishop (i.e. burping the worm) while on the phone with her? And then shouldn't they fire him for cause once the investigation is complete?  It doesn't seem like MSU is handling this correctly.

Depends. Are you presuming MSU is lying about when they knew this? Or are you suggesting that their alleged internal policies are bogus and they should be able to ascertain the pertinent information at an earlier date?

Either of those are reasonable takes.

If you're just misinformed about MSU's public position, well, the answer is they claim only the investigator knew before USA Today published their story, per their internal policies based on best practices.

He's being fired for violating the moral turpitude clause in his contract, not for violating the school's RVSM policy. So they don't need to wait for the hearing. But I'm sure this will either be determined in court or with a settlement.

Is moral turpitude specifically defined? They both agree he masturbated.  Wasn't the investigation supposed to determine whether or not he sexually harassed her?  He said it was consensual. She says it wasn't.  Wouldn't the official determination of whether it was more than likely consensual vs. not consensual determine if there was moral turpitude?  Otherwise . . . on what grounds can they fire him for cause? Masturbating on the phone? Cheating on a (possibly estranged) spouse?  Being a creep generally? Just in case you or anyone says I'm victim blaming again, I'm just wondering from a legal/contract and HR perspective how the order of things go.  I think he should/will be fired, I just don't understand the timing given where things stand with the investigation.

MSU's notice to Tucker is clearly stating that it's firing him for cause for coming on to a school vendor (sorry, couldn't resist the pun), regardless of whether or not she reciprocated.

Is that a violation of his moral turpitude clause? I think we all know Mel Tucker will be challenging that with lawyers.

Mark "Lonely" Schlissel got his ass thrown out for having a very consensual relationship with a subordinate at our school. I think he could have gotten away with it had they disclosed their relationship early on or something...I don't really recall how that went down or the rules and I don't know MSU's policies on these matters.

Moral terpitude means “an act or behavior that gravely violates the sentiment or accepted standard of the community.”

 The story broke and the response to it shows the community thinks he violated accepted standards. As Brian noted, the only people ok with his behavior are Zach Smith and some other douchebag.

Not super well informed take here.

It's not criminal law, no one's charged with something to go to prison over, and the standard isn't beyond reasonable doubt. While IANAL (heh) but I did take LSATs! - civil law is full of words like "reasonable" that are bound to interpretation. 

The term moral turpitude is vague so as to be inclusive, and usage of such words means you don't have to spell out every situation that qualifies, and also allows it to change over time or jurisdictions... things like obscenity are interpreted differently in different regions and are mostly by state IIRC. People in some big coastal city might have different views on this kind of thing than say a small southern town.

There's probably a body of applicable case law to refer to and I would guess that that line's been crossed, hence the notice of termination. Engaging in a sexual encounter that is dubiously consensual while being married to someone else would certainly be immoral wouldn't you say? The highest paid public employee in the state... making $10 mil of citizen tax dollars and on the hook for $80 mil more... with a well-known sexual assault advocate and former victim... whom he is engaging as a consultant to daylight this very topic? Someone in his position has to almost contractually run away from anything that might even be construed as immoral, much less go as far as he where he went down the path of bad decisions.

Maybe you wouldn't say so even still, and that grey area is where his lawyers will have to earn their fees. But it sure seems like this guy made a series of bad decisions, not illegal decisions per se, but immoral, I think that's a no-brainer that he violated his contract and is guilty of being an immoral turd.
