Litigation Dropped, Michigan Suspends Harbaugh Comment Count

It isn't justice, but the justice system, at least for the moment, is out of the process. Michigan agreed to suspend Harbaugh for three game days, which means he will not be on the sideline against Ohio State.

A Statement from the University of Michigan

"This morning, the University, Coach Harbaugh, and the Big Ten resolved their pending litigation.  The Conference agreed to close its investigation, and the University and Coach Harbaugh agreed to accept the three-game suspension. Coach Harbaugh, with the University's support, decided to accept this sanction to return the focus to our student-athletes and their performance on the field.  The Conference has confirmed that it is not aware of any information suggesting Coach Harbaugh’s involvement in the allegations. The University continues to cooperate fully with the NCAA’s investigation."

The Big Ten also issued a statement:

The Big Ten Conference’s commitment to student-athletes, sportsmanship and the Commissioner’s duty to protect the integrity of competition will never waver. Today’s decision by the University of Michigan to withdraw its legal challenge against the Conference’s November 10th Notice of Disciplinary Action is indicative of the high standards and values that the Conference and the University seek to uphold. The University of Michigan is a valued member of the Big Ten Conference and the Conference will continue to work cooperatively with the University and the NCAA during this process.

There are a lot of questions unanswered: Did Michigan roll over, learn more, or get something in return? Did the Big 10 threaten something else and what? How will this affect the NCAA investigation? How does this affect Harbaugh's contract negotiation? Most of all, will the conference continue to gin up penny-ante violations then gang up on Michigan every time the football team is good, and what does this mean for the conference's future and Michigan's commitment to it? How much will Harbaugh's absence affect them in what was already the most important football game ever?

Maybe they (UM) are getting in front of the NCAA on this issue, like with the cheeseburger suspension. Maybe a conference-imposed suspension on Connorgate will carry more sway with NCAA than the self-imposed earlier one.

I hope they got more from the deal, like Tony's resignation.

Agree, but I’m choosing to be the crazy optimist here and hope this settles both NCAA matters quickly.  “Oh that was too much punishment on the sign stuff, but we were mad about only 3 games for the other stuff.  So, let’s call it even and move on with our lives?”  I know, I’m nuts.

If that’s true, I don’t like it.  You fight these things, especially the way it was handled.

There is literally nothing either the Big Ten or NCAA could have at this point that warrants backing down.  The University can not make the process argument for weeks, which was the correct argument, and then back down last minute.

This looks so bad!  So fucking disappointing!

Hateful persecution won one. I understand the concept of giving the attention back to the kids. But you have to fight when up against hateful persecution. Sucks so bad.

So we voluntarily withdrew our request for a TRO...which is different from reaching a settlement w/the B1G. I'm no lawyer and don't know why we would do that now, but my speculative guess is that the NCAA/B1G has more evidence that would have come out and made this whole thing worse. In any case the timing is very suspicious to me; if Michigan/Harbaugh were simply trying to limit distraction(s) then why wait until the day before they travel to MD?

Did the statements by the University and Conference not clue you in on the settlement?  One thing that almost never appears on the docket is an explanation of the resolution or even the fact that the matter was resolved at all.  What always appears, however, is the dismissal if that's part of the resolution.

Maybe I am being pedantic but I don't like the title of this article: "Litigation Dropped; Michigan Suspends Harbaugh".  Technically, the BIG10 punished the University of Michigan and the form of its punishment was to ban Harbaugh from being on the sidelines for 3 games. If I recall, the BIG10 in its letter admitted it didn't have evidence of wrongdoing by Harbaugh and its punishment of banning him from the sidelines was a punishment of the University, not him. The title makes it seem that the University is suspending Harbaugh which isn't the case. The University is simply not fighting the punishment the BIG10 (unfairly) administered against the University. 

This matters to me because I want the University to announce a huge contract extension for Harbaugh at the start of next week. That wouldn't be happening if the University was suspending Harbaugh.

The result was inevitable. The timing was not. The Big 10 wanted to punish Harbaugh and it would have done that eventually. Michigan's due process arguments might have delayed things but it would not have carried the day in preventing punishment. I'd rather get it out of the way now rather than impact the Big 10 Championship game--because we are beating OSU--or a playoff appearance.

I was more concerned that we would win the TRO than lose it.  Prevailing on the TRO would not mean the B1G can’t punish us.  It means the B1G can’t punish us now.  If the NCAA found a violation, who knows what Pettiti would have done.  If we got an agreement that this suspension resolves the issue based on what is currently known, then I am super happy about this.  It also takes pressure of the NCAA to do anything additional.  I suspect Michigan thinks the NCAA will just say, “Minor violation, time served under the head coach responsibility rule.”

Not what I wanted to happen, as a Michigan fan, but also not unexpected. 
 

Michigan gets to go forward knowing exactly what they have to do coaching wise and the players aren’t on edge not knowing whether Harbaugh will be there or not. Also, it seems on the surface, that any other “evidence” against Michigan related to this, of which there sounds like there have been rumblings about, that UM will not face any other punishment from the b1g. 
 

The b1g and vocal leaders against Harbaugh and Michigan get their stupid pound of flesh, without a lengthy and potentially bloody court process that would probably tarnish the entire conference and not just Michigan. 
 

For Michigan it sucks, especially for something that so many coaches and ex-players consider a part of the game. 
 

Im thinking the players will be able to put all of this behind them and focus completely on their next two games, which I imagine was also a consideration by Harbaugh.

Nothing significantly new. Neither BIG nor UM liked dealing with the uncertainty of the courts which could burn either of them.

We get a cap on our losses, and we demonstrated that we stand by Harbaugh, as the offense is against the University, not against Harbaugh (though he manifests the punishment).

BIG realizes we do, in fact, have the capability of pushing back.

We get opportunity to beat Ohio without even needing our head coach physically present.

 

It's an enema for all involved.

 

And there will be behind the scenes payback.

But Harbaugh will be back. He doesn't go like this.

 

Oh, and it also opens the tiny crease of the doorway a little bit wider for demand for a rematch in the playoffs in the event of a narrow Michigan Harbaughless loss.

I don't understand the point of this when the NCAA investigation is ongoing. In litigation, typically defendants want to settle with everyone at the same time to limit exposure. Now Harbaugh could be subjected to double penalties.

To give in to a punishment from the Big Ten when they didn’t even do an investigation, with a potential punishment still coming from the NCAA, seems like a bad approach.  The Big Ten was scared of a public courtroom drama and we let Petite off the hook.  Weak sauce.

Hard to say if OSU is happy or sad about this. On the one hand, your nemesis isnt on the opposite sideline. OTOH, now the pressure is really on Day to win. If you lose this game you might get fired. That whole team before had an excuse to lose to Michigan, now theyre gonna get skewered if they do

I'm pissed about this surrender.   They should have at least gotten the suspension shortened to 2 games so he would be on the sideline for the Game.

I'm worried about what this portends, and also worried about how it looks.
