What’s the legal theory behind the lawsuit?

Targeted harassment.

Reece Davis: "THIS IS SERIOUS!! IT'S A RULE! YOU HAVE TO FOLLOW IT!!"
You mean like the No NIL Inducements rule Reece? Haven't heard ESECPN opine on the seriousness of that one.
October 21st, 2023 at 9:42 AM ^
I think I hate Rece Davis now. It’s not up there with Brunel crying about deflated footballs but it was a little too extra.
October 21st, 2023 at 9:51 AM ^
I've always hated Reece Davis. He has always hated Michigan, and makes fun of them any chance he gets.
October 21st, 2023 at 11:13 AM ^
Yep, he's just a dick.
October 21st, 2023 at 9:42 AM ^
Wow, the whole panel ganged up against Desmond. Especially Reese (Alabama) Davis. Really? An Alabama guy casting judgement on any college team?
October 21st, 2023 at 9:50 AM ^
Davis has already rendered Michigan guilty. He made that very clear
October 21st, 2023 at 9:55 AM ^
Desmond should have just said “this is a big nothing burger”
October 21st, 2023 at 10:38 AM ^
He called it comical.
October 21st, 2023 at 9:44 AM ^
Imagine how much worse OSU is going to be now that teams will be more vigilant going forward and doing a better job of concealing their signs. And not just OSU, but all the big boys. Hypocritical fucks, all of them.
October 21st, 2023 at 10:01 AM ^
OSU will be fine - they're tuff.
October 21st, 2023 at 12:38 PM ^
like a titmouse
October 21st, 2023 at 3:22 PM ^
You win the day sir!! Well done!
October 21st, 2023 at 9:53 AM ^
That’s not a terrible overall take.
October 21st, 2023 at 11:46 AM ^
"beyond the pale" ?- I guess he doesn't use that expression the way I would. I think of it as a substitute for egregious.
October 21st, 2023 at 2:37 PM ^
“Beyond the pale” would be Stalions hiring a vast army of hookers to seduce opposing coaches into divulging the signs.
October 21st, 2023 at 5:21 PM ^
I agree. Beyond the pale seems incongruous with everything else he said. And everything else he said was completely fair and reasonable. There are comments in this thread above that say Reece himself was "beyond the pale" in his criticism on Gameday. But if his take on Gameday was the same as this video, I don't see the problem, at all. I've heard way worse.
October 21st, 2023 at 9:47 AM ^
Almost 10am and no Punt/CounterPunt yet.
It's probably hard to find the right approach to writing about a game that featured an attack last year, and a masturbating coach, and a week of cheating allegations.
October 21st, 2023 at 10:03 AM ^
They get extra time for a late game I think
October 21st, 2023 at 9:49 AM ^
“We don’t give a damn about the whole state of Michigan.” - People who literally wrote an entire song about Michigan.
October 21st, 2023 at 9:52 AM ^
No doubt, they say Michigan 4 times and ohio once. Inbred fuckwads.....
October 21st, 2023 at 10:29 AM ^
Double post
October 21st, 2023 at 10:33 AM ^
They should be thankful this man doesn’t file a copyright/intellectual property lawsuit as they clearly stole that tune from The Old Gray Mare from him.
October 21st, 2023 at 11:11 AM ^
My favorite is when they sing that and then immediately after do their "Buckeye Bounce" to a song by a band...from Michigan.
October 21st, 2023 at 9:49 AM ^
Reese Davis and Pat McAfee have already very clearly found Michigan to be guilty, and it is obvious Davis wants Michigan to pay, even if the NCAA finds them to be innocent. Unwatchable.
October 21st, 2023 at 10:39 AM ^
There is literally a video in this thread with his reaction.
Relax.
October 21st, 2023 at 9:50 AM ^
Again, some rando on a message board, so take it for a grain of salt, but saw this posted on another message board:
October 21st, 2023 at 10:02 AM ^
Seriously, if the NCAA is that fucking malleable to teams griping, how do we not have NCAA charges of NIL Inducements bubbling up all over the place?
You know, something actually serious that is actually happening everywhere.
October 21st, 2023 at 10:03 AM ^
If this were true why would Michigan be turning over staffers computers? I hope it's the case that the NCAA walks all this back but think it's doubtful.
October 21st, 2023 at 10:33 AM ^
Because now that the story is out there they have to at least look into it.
October 21st, 2023 at 10:42 AM ^
The NCAA doesn't walk anything back.
At best they'll drag it out for 2 years and then drop the investigation with no penalties. It'll be a blip on the ticker for a day.
They just let it die.
Wait for summer 2025 on some random Tuesday in late June for this investigation to be over.
October 21st, 2023 at 11:14 AM ^
I've heard serious (as in not joking, but still unsubstantiated, of course) that Day had a hand in it. Wouldn't surprise me at all, the post-Notre Dame temper tantrum clearly showed how much the Michigan losses are getting to him, and desperation often follows that level of distress.
October 21st, 2023 at 11:52 AM ^
On Seth's Twitter feed, he liked comments from a coach/consultant who says the NCAA is investigating the wrong team. He insinuates that it's actually OSU that is stealing signs based on his experience with helping teams disguise signals, so Day is definitely taking a play out of the psychological projection playbook.
I guess when you are 0-2 vs your biggest rivalry and are on the hot seat because of it, you will do anything to survive...
October 21st, 2023 at 11:49 AM ^
This is at least a logical read of what might have happened.
October 21st, 2023 at 9:55 AM ^
I never thought I would say this: I miss David Pollack.
October 21st, 2023 at 10:25 AM ^
Me too.
Excuse me while I go rinse off in the shower.
October 21st, 2023 at 9:56 AM ^
Poor Penn State. Poor irrelevant Penn State.
They are Ohio State's opponent today, and all Ohio State is focused on is Michigan.
October 21st, 2023 at 10:04 AM ^
If they're focused on Michigan today, PSU will get them. PSU has a legit defense, but if OSU is paying attention I think their offense (ie: Marvin Harrison Jr) is better than PSU's offense.
October 21st, 2023 at 10:48 AM ^
I always root for OH State to lose. It might be that the Buckeyes have already lost to Michigan this year.
Hopefully, Ryan Day looks bad in this game against PSU.

Urban Meyer “ this is very serious I’ve never condoned cheating !”

October 21st, 2023 at 11:16 AM ^
Quite a rich statement from the Cluster King of Jacksonville. Aside from Buckeye nation who even cares what Urban thinks about anything . I'll say this for Ubz though, he's a Grinder. Just sayin.
October 21st, 2023 at 10:01 AM ^
The articles about this mention NCAA bylaw 11.6.1. The bylaw says off-campus, in-person scouting of future opponents in the same season is prohibited. That can be found in Article 11, governing conduct of “Athletics Personnel.” Personnel includes coaches, managers, graduate assistants and volunteer coaches. If Stalions was able to get unaffiliated people to tape games and send him the film, he discovered a loophole big enough to drive a truck through. He may have violated the spirit of the bylaw, but as written, I think he’s innocent. But that subtlety is lost on tools like Rece Davis who are only interested in controversy and ratings.
October 21st, 2023 at 10:08 AM ^
Yep. Guilty until proven guilty. There is no option for found innocent. That is the world we live in.
UM or Harbaugh should sue NCAA and find all the other allegations as part of discovery.
October 21st, 2023 at 10:39 AM ^
Seems like a good lawyer could make that case. If the NCAA has to start arguing semantics then they are losing.
