Sources: Resolution talks in NCAA's case vs. Michigan hit impasse over Jim Harbaugh's refusal to say he lied

A potential negotiated resolution in the NCAA infractions case involving the Michigan football program broke down this week after the NCAA demanded head coach Jim Harbaugh state that he lied to investigators, multiple sources told Yahoo Sports.

It is generally challenging to prove someone knowingly lied without detailed contemporaneous evidence, which sources say the NCAA either lacks or simply doesn't exist.

If coaches on FBI wire taps openly talking about paying players (before NIL was a thing) isn’t “detailed contemporaneous evidence” Jim and UM need to tell NCAA to pound sand. Enough of this! Hang the banners!

1. Request the evidence against to "avoid the appearance of a Kangaroo court"

2. In the interest of fairness so claimed by this body request the hearing be public during the offseason so all other transgressors can also be questioned and thereby removing further notions of singling out a stakeholder and removing agendas.

3. Entrust Roger Goodell with your cell phone.

4. Ask Kevin Warren what he knew and when did he know it.

5. Have the Tunnel seek immunity.

6. Ask Matt Weiss if he has previously been contacted by NCAA investigators or surrogates.

7. Limit length of hearings to two summer weeks or less so no bad precedents can be inferred.

The NCAA is the prosecutor with a weak case who wants the defendant to plea out to save his case.  Harbaugh has admitted to the actual violations (all pretty dubious and one that isn't even a violation anymore) and apologized.  Hit him and the team with whatever minor penalities that are appropriate and move on.  But expecting him to admit that he didn't take your stupid investigation, brought about by a disgruntled former staff member who was an idiot and has been shitcanned by two jobs now in a span of 3 years, seriously is asinine.

If Warde is on the comply, bend over and take it path and Harbaugh is on the fuck off path then I can understand how there appears to be a wedge between Warde and Harbaugh right now.  And Ono is decidedly on the Harbaugh path.

There's nothing to admit.  Fuck the NCAA...

And this is where Warde needs to step up.  JFC, the 'silent, behind the scenes' shit doesn't work here.  Publicly task the NCAA with explaining why this is such a big deal when LSU, Arizona, UNC, Arkansas, et all got off scott-free for egregiously more serious violations.  Task them to explain why the allegation was released on Championship Game weekend.  Task them to explain why Swinney and Saban can 'run into' recruits in airports and in high school counselor's offices during dead periods, but a commit can't stop by and say 'hi'.

One press conference to ask these questions, and say we'll respond when we having satisfactory answers, and this is over.  (And every other program in the country laughs its ass off and high five's Warde on his walk away from the podium...)

In basketball yes Louisville is a bigger brand than Michigan.

To anyone downvoting this you do realize Louisville basketball has double the revenue of Michigan basketball. Also was no one else in Indy for the 2014 tourney? There were far more Louisville fans. Last year in Indy CSU had as many fans as Michigan and UT dwarfed the Michigan crowd. I love Michigan bball more than I do football, but it is ok to admit Michigan basketball is not even a top 10 brand. In football and overall it is not comparable Michigan is much larger, but in basketball, the revenue generating sport for the NCAA, by any metric you want to use Louisville is a bigger brand.

If the NCAA and UM don't settle, who is the final judge or jury for whether Harbaugh lied? It's still basically the NCAA, right?

Edited to add: It looks like the NCAA suspended the prior independent review process in January 2022 and put a new "peer review and appeal" process in its place, with the new process taking effect 1/1/23.  Should be great.

This is speculation.

It may be like a business expense.  You need a receipt for any expense over $25.  Harbaugh spent $27 at Brown Jug. 

Harbaugh didn’t keep the receipt, or perhaps lost / misplaced it.  Harbaugh paid for it out of his pocket - and didn’t report it.  The players were not “prospects”, they had already committed and signed their NLOIs.

I do find it funny that the vast majority of comments on reddit/cfb are fans of other teams making fun of the NCAA about this.  It feels like even 5 years ago this would have resulted in non-stop trolling because no one knew what the NCAA boogeyman would do.  Now no one cares, which is kind of how it should have always been.

Wait…. Texas spends $280K for a recruit’s official visit, and it’s not a problem.

Harbaugh, during CV 19, buys two hamburgers (maybe they were cheeseburgers) - during a period when the campus was either “on”, or “very near” lockdown procedures during CV - when I’m pretty sure the only people allowed to use campus dining facilities were registered and enrolled students  - these two young men had already committed to the program and signed their NLOI.  And, this is a huge issue.

$280K is ok.. $25 at Brown Jug is a violation.

Yeah, the NCAA certainly has its priorities in order.

I wish that Michigan would publish a detailed description of the alleged nature of the Level 1 violations so it can be compared to the NCAA's own definition of what constitutes a Level 1 violation.

I don't think they have a case to stand on for Level 1 based on what I hear. If being evasive or not being cooperative is the basis of their case, they don't have any legitimate claims for Level 1

For all of a Jim Harbaugh’s quirks, he’s not a liar. If anything he’s honest to a fault. And he makes it very clear that he values the weight of his word… even when it pisses others off.

If he did intentionally mislead investigators, this would be a massively unworthy fight to pick. UM would have suspended him a game or 2 and call it a day. It was burgers, nobody cares except the NCAA.

The only reason you fight this and hire a lawyer is because Jim cares about being honest, and his reputation… so he’s not going to admit it if he didn’t do it, end of story. 
 

The NCAA will still probably suspend him because they can. And now it’ll probably be for more bc he isn’t admitting what they want him to. I dunno why they bother though… just keep on telling their refs to make BS calls against us on the field. That’s the real punishment.

I haven't consumed as much information about this story as others here, but this now basically seems like the NCAA is saying "You won't help us prove that you lied, so just admit you lied and we can move on."

 

the poster who made this comparison earlier itt nailed it: that this is like a prosecutor asking a defendant to take a plea because the prosecutor knows his case is weak.

"I'm having trouble proving your guilt, so just admit to it.  please."

Popcorn sales have hit an all-time high in Columbus and East Lansing as they watch and pray that this somehow leads to our downfall.

Albert Breer (OSU alum) was on the radio this morning, trying to compare this to Tressel. OSU/MSU logic equates buying a couple burgers to hiding a decade of free tattoos and other gifts.
