If you use a performance review as an example assuming that publicly releasing that information is against policy. Trustee A could say to a third person that Employee B was graded as unsatisfactory even if they weren't.
That releasing that information would be a breach of confidentiality and false. To force it into only one specific bucket would allow you to saying that lying about confidential information isn't a breach of confidentiality because it is a lie.
If the president's doctor falsely and without authorization says he has terminal cancer, should he be able to say its not a HIPPA violation because it is a lie?
The university boards are a great example of how not to choose public officials. Nobody votes for them in a primary election, they are chosen at a party convention based on how much money they donate to the respective party, not any type of qualification.
Then in the general election, people normally don't care at that point on the ballot so they leave the option blank and straight party voting patterns determine the winner. Most people don't select their party so they can vote a certain way in BoT/ BoR elections, so theses clowns are elected based on who people wanted to win a different office.
Just a case study of how something that looks like democracy, isn't always democratic.
Other than a global pandemic, highly rated pro prospects opting out or getting hurt, and having had about a decade track record of success as a head coach at college and pro levels, they are totally the same...

To be completely honest, I would not tell anyone alleged to have suffered from SA/SV at the hands of a football player at ANY university to go to university police or even local college town police if other options to report exist. I would attempt to go straight to the state police over those avenues. The more separated the documentation and evidence is from university power structure the better.
University police chiefs report to university presidents. Its foolish to sit on a moral high horse and rely on a "we are better/morally superior" mentality when the fundamental problem is that the school would have a financial interest in protecting a key employee.
It will be a good test case of whether recruiting is only NIL or if any other factors are relevant. Smith has no Midwest recruiting connections so they are going to be forced into outbidding everyone in order to win those battles
Apparently everyone in the B1G who has ever paid a buyout is a shmuck, you can just have someone commit a vaguely unsportsmanlike act and the commissioner can void the contractual rights of another individual associated with your university.
The defense and rebounding need a ton of work, but hopefully some of that is not being used to each other in game situations. Very fun to watch with a ton of positives, but also occasionally laughably frustrating.
You don’t want to leave the B1G as a first option, you want to win the lawsuit against them on good faith/fair dealing grounds and basically force the B1G to back the fuck up and leave us alone as a condition of us staying.
Defeating the B1G in (court) battle is mostly about setting the eventual peace on our terms. (Petitti’s head metaphorically on a spike, and they drop their entire crusade)
But the logic makes sense, especially if the B1G is organized as a partnership or LLC.
Then the conference is resident in all states with members, and M is clearly a government entity.
