Eight Nebraska Players Sue B1G for Postponing Season

Submitted by ThisGuyFawkes on August 27th, 2020 at 2:43 PM

The lawsuit "does not seek damages greater than $75,000 but states that the Big Ten's postponement hurts the players' future football prospects and their ability to market and brand themselves"

Good for them.  Although, since they play for Nebraska, their "future football prospects" were probably already limited.  The best they could hope for was to outhit the other team.

Some Cornhuskers are suing the B1G?

Wow, I haven't heard any rumors on this, but I'll keep an ear out.

This lawsuit is weak. Doesn't have a kernel of truth in it.

There's no way they win. They are going to get creamed.

I bet the B1G responds, "Aw, shucks. We'll change our mind."

Sorry for the....corny puns....

Well, someone was going to do it.  Not sure that Nebraska players were the best lot to do so, given potential future earnings from football.  But they have as much right to belief in that earnings potential as anyone else...

Good luck to them?  I don't wish them bad luck.

We've already watched Scott Frost's team play the last two years, and let me tell you buddy, the games they played certainly didn't help their future football prospects or their ability to market themselves. Hell, I'm not sure Adrian Martinez throwing a football is legal in any other state than Nebraska

Can they sue their teammates and coaches as well?? ....missing the exposure of a a bowl for 2 straight years can't help the future earnings prospects either.

It appears to be the same logic about third-party beneficiaries covered in a UV some time ago that was, legally, somewhat dubious.  It is telling that this appears to be a state court filing (notice the under $75k total, which is the lower bar for getting a case into Fed), even though the conference is multi-state and you'd assume would be federal in nature.

Anyway, it's their right to sue and for their lawyer to push them to do it.  I'm not sold said lawyer really cares all that much about them, but that doesn't mean they shouldn't seek a remedy for their grievance.

I haven’t read the complaint yet.  Is there an argument that these players aren’t domiciled in Nebraska? Also, I haven’t researched this before, but I wonder if there’s a way to allege something similar to fraudulent joinder in the amount of damages they’re seeking.  That is, how can you plausibly claim less than 75K in damages.  Otherwise, all you’d ask for is an injunction.  You shouldn’t be allowed to say I’m alleging damages under 75K and and then get to seek more at trial.  Or at least whatever you prove up and the jury awards should be reduced.

So if a player gets benched by a coach, can they also sue for damage to their "future football prospects and their ability to market and brand themselves"?  The cause may be different, but the effect is the same.

Eight Nebraska Players Sue B1G... hence supporting the theory that in addition to covid, 'futile gestures' are also highly contagious
