The best CFB extended highlights channel on YouTube, an incredible resource for us all, is being shut down by YouTube "due to copyright strikes received and accumulated recently," presumably by the greedy capitalists at Fox Sports. He is starting a new YouTube channel to continue his work, which you can find here.

Onward for the proletarian highlights revolution!

Your stuff and our stuff are 100% textbook fair use cases. Here's the language:

Under Section 107 of the Copyright Act 1976, allowance is made for fair use for purposes such as criticism, comment, news reporting, teaching, scholarship, and research. Fair use is a use permitted by copyright statute that might otherwise be infringing. Non-profit, educational or personal use tips the balance in favor of fair use.

We're using 1 play as a visual aid for educational commentary, which is a use case specifically carved out the Fair Use law. In your case you don't even make money off of it, and what you do covers every one of the fair use cases.

This is why we countersue them every time this comes up. They make these claims blindly, using AI to find content and ignoring any fair use considerations. What you are doing is protected by law; what they are doing is not.

Agreed, although "not making money" is not, in and of itself, enough to make something fair use.  I can't upload a full video onto a free server and say "hey, I'm in compliance."  "Tips the balance" means exactly that -- if it's an edge case, the fact that it's non-monetized will prevail.

Simply compiling highlights -- not fair use.  Compiling highlights with a lot of narrative around them to explain what the highlights mean in context -- fair use (but I'm not surprised you've been sued).

I'm not familiar with Low Hanging Fruit (sorry readyourguard), but the same logic would apply -- you'd need to have critical analysis or a teaching element to qualify.

I don't bring this up to argue, but rather because a lot of people seem to think that "fair use" is "anything really short" or "anything that I don't monetize," and those are just not true.

I enjoyed his channel and hate how networks (mostly incorrectly) enforce copyright on these user highlights. That said, I'm really not surprised he got nuked, he was pushing the limits of fair use quite a bit. His cut ups included the vast majority of plays with only a few taken out here and there.

This needs to be a national sports story to pressure Fox into not being dicks. It hasn't just been The Game, it's been anything aired on Fox. Matt made a post about 10 days ago on his community tab saying they were striking anything aired on Fox. Where you at, ESPN? Stick it to the competition by calling them out on this insanity.
