Part of me wishes the coaches didn't have to do these press conferences every day. What the heck is he supposed to say and does he really believe that crap. Like he's going to use the exact same plays that they used against Syracuse that they used last year.

I know. I'm an editor at a magazine. We deal with this frequently. But the copyright laws vis-a-vis public forums are kind of blurry. I don't know that there's a documented case of a publication filing and winning a law suit in such an instance. (Brian/MGoBlog would likely be the one they'd go after, and we don't want that, but in this stage of new media, it would be a difficult case to make still. Is quoting and not linking a similar violation? Yes. But there are no cases in that instance either--something the Freep itself would largely be guilty of.) In any case, I do mention that it would be nice if they excerpted quotes here, because really, I don't care about the rest.

If you were a lawyer and Brian was your not-so-rich client, do you think the appropriate standard is that a case has never been brought & won? If this is true--which, who knows--it's only b/c so-called content producers have used the DMCA to scare people who aren't even arguably infringing a copyright into submission well in advance of anything resembling a trial. Even if the worst thing that happens is that Brian gets a bunch of takedown notices, why not just abide by the community standard (and, really, the legal standard) and not reproduce the entire article? Do the copyfighting civil disobedience on your own site. Copyright actually isn't particularly blurry when it comes to this, no matter what you think of 'new media.' And if you work at a magazine or, you know, browse the Internet, you should be able to tell the difference between linking and quoting some portion of an article and reproducing the entire thing. /Drew Sharp
